Educational institutions must follow constitution, laws: HC
The High Court on Sunday observed that all educational institutions, including madrasas, have to conduct academic activities in line with the constitution and relevant laws.
No student can be tortured physically or mentally as per the earlier directive of the High Court.
An HC bench comprising Justice FRM Nazmul Ahasan and Justice Shahed Nuruddin said this after going through the compliance reports submitted by the deputy commissioner and Superintendent of Police of Chattogram.
It the laws and constitution are violated by any educational institution, the education ministry, Directorate of Education and education boards can take appropriate legal action.
The court also said the academic activities of the eight-year-old student of Markazul Islami Academy Hafezia Madrasa, who was beaten up by madrasa teacher Maulana Yahya, cannot be stopped in any manner.
Earlier in the day, the DC and SP submitted two separate reports to the High Court, saying that the authorities concerned of Markazul Islami Academy Hafezia Madrasa have been cautioned so that incidents like beating up students do not happen in future.
Necessary legal steps have been taken against Maulana Yahya, the duo said in the reports.
A case has been filed against him and he has been arrested, produced before a lower court and sent to jail in connection with the case, they mentioned.
Deputy Attorney General Abdullah Al Mahmud Bashar placed the reports before the HC bench in line with its suo muto (voluntary) order of Thursday.
DAG Bashar said that necessary steps have been taken to ensure security of the victim and his family members, as well as his treatment.
The HC bench on Thursday wanted to know what legal action was taken against madrasa teacher Maulana Yahya for beating up the student mercilessly.
The court asked the government authorities concerned to submit a report to it by Sunday (today), detailing the action taken against Maulana Yahya.
The HC bench came up with the suo moto (voluntary) order after DAG Bashar placed some newspaper reports on the incident before the bench.
Video footage showing the child being beaten by Yahya has gone viral on social media.
